December Was A Great Month For Adversary Proceedings

December was a great month to settle Adversary Proceedings, and Our Clients are glad that it was. Attorneys, David Fineman, David Lampley, and Carmen Dellutri were able to settle a record number of adversary proceedings and put more money back into our client's pockets than any other month in the history of the firm.

An adversary proceeding is commenced by a debtor for a specific reason. In essence, it is a lawsuit brought in the bankruptcy court. Usually, in our cases, some of our clients will complain that despite the Creditors being notified by the Court of their bankruptcy filing, the Creditors continue to harass them with calls and letters. At the Dellutri Law Group, we take the United States Bankruptcy Code seriously. If a creditor chooses to intentionally ignore a Federal Law, then we will seek relief in the form of an adversary proceeding and ask the Bankruptcy Judge to uphold the law. Of course, there are other reasons to file adversary proceedings. As a matter of fact, there are too many to list here, and I'm sure Attorneys Fineman and Lampley will continue finding more ways to pursue creditors.

I will have to admit that there are many reasons why I love practicing consumer bankruptcy law, but one of the best is being able to present a client with a check from a creditor. The bankruptcy process puts the parties on an equal playing field, and for many debtors who have been beaten down by the debt collection process, a settlement, no matter how small or large equals justice.
