Discharge Violations Pay Off for Dellutri Law Group Clients

This post is submitted by Carmen Dellutri, Esq. founder of the The Dellutri Law Group, P.A. Mr. Dellutri is a Board Certified Consumer Bankruptcy Attorney and is also one of the founding members of the Bankruptcy Law Network.

Normally, when a client goes to see a bankruptcy attorney for a bankruptcy consultation, it is usually the worst part of their day. Imagine what could be worse than walking into an attorney's office and putting all of your financial details on the table for discussion. Most people would rather be any other place in the world. Yesterday, I had the honor of sending a client a check for four (4) times the amount she paid me in attorney's fees for handling her bankruptcy case. That's right, the attorney sent the client a check. This happens all the time at the Dellutri Law Group, and the clients love it.

I will call the client Ms. Happy. Ms. Happy came to see me several years ago with her financial problems. After some long discussions and some soul searching, Ms. Happy decided to file for bankruptcy. Everything went along fine, and Ms. Happy received her discharge. But then something happened, something that we warned her about, the debt collectors started calling again. So, rather than panic, she called her attorneys, Carmen Dellutri and David Lampley. After investigation, the lawsuit was filed. Based upon the seriousness of the violation of the Discharge Injunction, the case was able to be settled without protracted litigation. The end result being that Ms. Happy will receive a check for her damages which is four times higher than her initial attorney's fee. So, she actually made money by filing for bankruptcy.

The funny part about this is that it happens all of the time. Most bankruptcy aw firms do not seek to protect their clients rights, we do. The best part is that when we do, our clients benefit from our services. The scary part about this is that other law firms do not protect their client's rights. I don't know of another law firm in Southwest Florida that sues as many creditors as we do.

Several months ago, I wrote a six part article for the Bankruptcy Law Network titled Violations of the Bankruptcy Discharge May Have You Seeing Green! Here is a link to the articles: Part I, Part II, Part III, Part IV, Part V, and Part VI. I hope you read this article. It could have you seeing green.
